Compliance evaluation is a key element in assessing the effectiveness of fisheries monitoring, control and surveillance (MCS) programmes and by extension the policies to which they relate. Trends in compliance can be very informative, both from a risk management perspective and also to gauge the rate at which industry is able to adapt to new policy or control measures. There are various ways in which compliance can be examined and assessed; their applicability and validity being dependent on data quality, fisheries, time series, the regulatory environment and the objectives of the assessment. Compliance evaluation is of particular value where compliance is used as a benchmarking tool by fisheries management agencies. Compliance may be expressed in several ways, both graphically and statistically. Perhaps the most appealing and visually comprehensible manner in which to express compliance is in the form of an index. The EFCA has been working since 2013 with the development of compliance evaluation methodologies, and is currently analysing with Member States the possibilities for an evaluation of compliance with the the landing obligation.

Member States Control Expert Groups (CEGs) assisted by the European Fisheries Control Agency (EFCA) have carried out an evaluation of compliance with the Landing Obligation in selected fisheries in the North Sea and North Western Waters. The latest evaluation was performed to report the findings over the period 2018-2020 for mackerel fisheries and for significant demersal fisheries in the North Sea and North Western Waters.

The EFCA strategy to support regionalisation includes developing regional approaches and working closely with the regional bodies created by the Member States in order to promote in particular the uniform implementation of the Landing Obligation (LO) and also the adoption of decisions facilitating control in all the areas.
In this regard, EFCA cooperates through the PACT approach (Partnership, Accountability (compliance), Cooperation and Transparency) with all formally constituted regional bodies created by the Member States. The PACT approach allows assistance to the Member States in accordance with Articles 7 and 15 of EFCA’s founding regulation.
EFCA cooperates with four Control Expert Groups (CEGs) active in the framework of the regionalisation of the Common Fisheries Policy (CFP):
- Scheveningen (North Sea);
- BALTFISH (Baltic Sea);
- North-western waters;
- South-western waters.
Support for these regional bodies, through cooperation with the CEGs, is framed around the following subjects:
- Compliance evaluation in the context of the LO;
- Preparation for the implementation of REM in fisheries control;
- Standardisation and guidelines;
- Cooperation with industry to promote compliance.
In addition to these main areas around which cooperation is organised, EFCA gives the CEGs support in their work of developing recommendations to the respective High Level Groups (HLG) on control and monitoring of the LO. EFCA also facilitates interregional cooperation by organising and chairing joint CEG meetings on horizontal issues in order to promote a uniform implementation and a level playing field across regions.
In relation to this regional cooperation work EFCA staff participate in the different fora where the LO is discussed (Advisory Councils, STECF (Scientific, Technical and Economic Committee for Fisheries), scientific organisms, research projects, etc.) and organises joint workshops between Member State regional groups and stakeholders.
To give effect to its coordination duties and legal obligations, the EFCA supports Member States in designing training programmes on fisheries control and inspection. A priority in the development of such training programmes is to create and make available reference materials for the training of the trainers of the fisheries inspectorates and of Union inspectors before their first deployment, the core curricula.
Essentially, the core curricula consist of a number of basic courses of practical knowledge for national fisheries officials involved in the control and inspection of fishing vessels and their activities. In the strive towards a level playing field among Member States and between the operators in the fishing community throughout the EU, a common core curricula for the conduct of inspections is key.

EFCA ensures that good quality data is available for the planning, risks assessment, implementation and evaluation of joint deployment plans (JDPs), facilitating the data exchanges between EFCA and EU Member States or regional fisheries management organisations. EFCA also coordinates the collection and analysis of information systems’ related requirements, providing assistance with data analysis, on an ad hoc basis, developing some reporting tools used for risk analysis, compliance indicators and data quality monitoring.
EFCA also collaborates with the European Commission (DG Maritime Affairs and Fisheries) in the definition and implementation of standards for the exchange of fishery activity and fishery control data.
Integration of the different systems is currently a key challenge as part of the implementation of the agency’s data governance framework, which will contribute to improving data quality and capacity to deliver a service to end-users.

This Call for Expressions of Interest was published in Official Journal S 211 on 30/10/2013 and the list resulting from this CEI is valid until 17/10/2017.
The European Fisheries Control Agency invites expressions of interest with a view to drawing up lists of experts to assist in the activities as detailed in the notice and related to the uniform application of the Common Fisheries Policy.
Natural persons interested are invited to submit an application in accordance with the rules set out in the notice for the purpose specified. The contracting authority will draw up a list of experts who meet the criteria laid down in point 12 of the notice. This list comprises sub lists, corresponding to each of the fields described at point 8 of the notice.
Fields covered by this CEI
The European Fisheries Control Agency ('the EFCA') is a European Union body located in Vigo, Spain, established to work in specialised areas of EU policy. Specifically, it was set up by the European Council (Council Regulation (EC) No 768/2005 of 25 April 2005 as amended by Regulation (EC) No 1224/2009), to strengthen the uniformity and effectiveness of enforcement of the Common Fisheries Policy (CFP) by pooling national means of fisheries control and monitoring resources and coordinating inspection activities.
The EFCA shall assist the Member States and the European Commission in the delivery of training for fisheries inspectors, in particular the delivery of core curricula for the training of the instructors of the inspectorate of the Member States and for the training of Union inspectors*.
The preparation of the Core Curricula requires to review and consolidate contributions via a web-based collaboration platform from national fisheries inspection services and the Commission and to fill gaps in the development of the Curricula in order to ensure consistency, coherence, uniformity and completeness.
The experts chosen within the framework of this call for expressions of interest shall provide technical assistance in the uniform application of the CFP, in particular the Core Curricula for fisheries inspectors. Therefore, these experts are required to have relevant experience, recognised expertise and specialised technical knowledge on the application of the CFP in preferably one or more domains of fisheries control and inspection.
*Article 7(a) and (b) of Council Regulation (EC) No 768/2005 as amended by Council Regulation (EC) No 1224/2009.

Data Protection Clause
The personal data collected by the EFCA in the applications is processed pursuant to Regulation (EC) No 45/2001 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data. It is processed solely for the purpose of determining the inclusion of the applicant in the CEI list and, subsequently, the possible offer of a contract as external expert.
Files relating to the selection of applicants including personal data will be retained in the service in charge of the call for expressions of interest concerned until the end of the procedure for which it is submitted, and in the archives for at least five years from the date on which the European Parliament grants discharge for the budgetary year of the closure of the call for expressions of interest. Files relating to unsuccessful applicants will be retained in the service in charge of the call for expressions of interest concerned until the end of the procedure for which it is submitted, and in the archives for 2 years following the closing of the call for expressions of interest. The above limits can be extended until the end of a possible audit if one started before the end of the above periods.
In compliance with the ex post transparency requirement outlined in point 14 of the notice, the experts' names and the subject of the contracts will be published on EFCA's website no later than 30 June of the year following contract award. Where an expert has concluded a contract of more than €15 000, the name, the locality (region of origin), amount, and subject of the contract will be published. The information will be removed two years after the year of contract award.
The applicant has the right of access to his/her personal data and the right to rectify any such data that is inaccurate or incomplete. Should the applicant have any queries concerning the processing of his/her personal data, these shall be addressed to the Head of Unit Capacity Building. The applicant has right of recourse at any time to the European Data Protection Supervisor.

Het Europees Bureau voor visserijcontrole is een agentschap van de Europese Unie. Het Agentschap heeft als opdracht te ijveren voor de hoogste gemeenschappelijke normen voor controle, inspectie en toezicht in het kader van het gemeenschappelijk visserijbeleid. Het EFCA hanteert daarbij het hoogste niveau van excellentie en transparantie zodat alle betrokken partijen het nodige vertrouwen schenken en meewerken en zo de effectiviteit en efficiëntie van de operaties van het Agentschap kunnen worden gegarandeerd.
Tijdens de hervorming van 2002 zijn de regeringen van de Europese Unie overeengekomen het Agentschap op te richten vanuit hun wil om in de Europese visserijsector een nalevingscultuur ingang te doen vinden. In april 2005 hebben zij met Verordening (EG) nr. 768/2005 van de Raad de nodige wetgeving daarvoor vastgesteld. De voornaamste rol van het Agentschap is de coördinatie van nationale controles en inspecties te organiseren en de lidstaten bij hun samenwerking bij te staan zodat de regels van het gemeenschappelijk visserijbeleid worden nageleefd en effectief worden toegepast.
De toegevoegde waarde van het werk van het Bureau schuilt in zijn bijdrage aan eerlijke concurrentievoorwaarden voor de Europese visserij zodat iedereen in deze sector de Europese verplichtingen in acht neemt en gelijk wordt behandeld, waar men ook actief mag zijn. Voorts draagt het Bureau bij aan een duurzame visserij doordat het zorgt voor een betere naleving van maatregelen op het gebied van instandhouding en beheer van visbestanden ten behoeve van huidige en toekomstige generaties.
In samenwerking met het Europese Grens- en Kustwachtagentschap en het Europees Agentschap voor maritieme veiligheid, ieder binnen zijn eigen mandaat, steunt het Bureau de nationale kustwachtinstanties.

EFCA tegutseb tippteadmiste ja läbipaistvuse kõrgeimal tasemel, et arendada kõigis osapooltes vajalikku usaldust ja koostöövalmidust ning kindlustada selle kaudu oma tegevuse tõhusus ja tulemuslikkus.
Euroopa Liidu liikmesriikide valitsused leppisid 2002. aastal kokku ameti asutamises, et reformida kogu Euroopa kalandussektori regulatiivvastavust. 2005. aasta aprillis võeti vastu ameti asutav õigusakt, nõukogu määrus nr (EÜ) 768/2005. Ameti põhiülesanne on kooskõlastada liikmesriikide kontrolli- ja inspekteerimistegevust, et kindlustada ühise kalanduspoliitika eeskirjade tõhus järgimine ja kohaldamine.

Koostöös volituste piires tegutseva Euroopa Piiri- ja Rannikuvalve Ameti ning Euroopa Meresõiduohutuse Ametiga toetab EFCA riikide ametiasutusi ka rannikuvalve ülesannete täitmisel.
